Welcome to Flux8Labs! These Terms and Conditions ("Terms") govern your use of our website, services, and products. By accessing or using any part of our platform, you agree to be bound by these Terms. If you do not agree with any part of the terms, you must discontinue use immediately.

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on this page.

User Obligations

Proper Use

  • Provide accurate and up-to-date information during registration
  • Maintain the confidentiality of login credentials
  • Use the platform lawfully and responsibly

Prohibited Activities

  • Attempt to reverse-engineer or exploit our software
  • Transmit spam, phishing, or malicious content
  • Violate applicable data privacy or intellectual property laws

Intellectual Property Rights

Our Content

All code, designs, data, and intellectual property created by Flux8Labs remain our exclusive property unless otherwise agreed in writing.

Your Content

You retain ownership of content you submit. By using our services, you grant us a non-exclusive license to use such content for operational purposes.

Financial Terms

Fees
All fees are outlined in individual service agreements and are payable as scheduled.
Taxes
All applicable taxes are the client’s responsibility unless explicitly mentioned.
Refunds
25% advance is non-refundable. Additional terms are detailed in the project agreement.

Legal Compliance

  • We operate in accordance with the Consumer Protection Act, 2019 (India).
  • Refund and support policies comply with Indian e-commerce and software service guidelines.
  • Any clause herein that conflicts with applicable law shall be deemed modified to comply with that law.

Data Privacy & Protection

We adhere to data privacy principles outlined under the Digital Personal Data Protection Act (DPDP), 2023 (India), and incorporate aspects of GDPR where applicable:

  • User data is only collected and processed with consent
  • We do not sell or rent user data to third parties
  • Users can request access, correction, or deletion of their personal data

Limitations of Liability

  • We are not liable for indirect or consequential damages
  • We are not responsible for delays caused by third-party services or force majeure events
  • We are not responsible for unauthorized access caused by user negligence

Project Terms

  • Timeline and deliverables are outlined in each agreement. Delays caused by client inaction are not the responsibility of Flux8Labs.
  • Scope changes will require additional costs and revised timelines.
  • Final ownership of deliverables transfers only after full payment is received.

Termination

We reserve the right to terminate service access for violations of these Terms or misuse. Clients may terminate their engagement at any time, subject to payment for work completed.

Dispute Resolution

Governing Law

These Terms are governed by the laws of Rajasthan, India. Any disputes shall be subject to exclusive jurisdiction of the courts in Rajasthan, India.

Mediation and Arbitration

In case of disputes, both parties agree to first attempt resolution through mediation. If unresolved, binding arbitration will be conducted in accordance with the Arbitration and Conciliation Act, 1996.
